Freespool Terms of Service
These terms are an agreement between you and Freespool Pty Ltd (ABN 31 702 737 291) (“we”, “us”) governing your use of the Freespool mobile application and related services (the “App”). By using the App you agree to these terms. If you do not agree, please do not use the App.
1. Using the App
You must be at least 13 years old to use the App, and old enough to form a binding contract where you live. If you are under 18, you should have a parent or guardian's permission.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own recreational fishing. You may not copy, resell, reverse engineer, or attempt to extract the App's underlying data or models, nor use it to build a competing product.
2. Accounts
Some features require an account. You are responsible for keeping your login details secure and for activity under your account. Tell us promptly if you suspect unauthorised access. You may delete your account at any time in Settings → Delete account.
3. The information the App provides — important
3.1 Species identification
The App uses artificial intelligence to suggest what species you have caught. It will sometimes be wrong. Identification is a suggestion only. You must confirm the species yourself before keeping or eating any fish. Some look-alike species are protected, and some are dangerous or fatal to eat.
3.2 Fishing rules
Size limits, bag limits, closed seasons and keeper guidance are provided as a convenience and may be out of date, incomplete or wrong for your location. Fishing rules change frequently and differ between and within jurisdictions. Always confirm the current rules with the relevant authority — your state or territory fisheries department in Australia, or the Ministry for Primary Industries in New Zealand — before keeping a fish. You are solely responsible for fishing lawfully, including holding any licence required.
3.3 Edibility, handling and health
Eating quality ratings, handling and preparation notes, and warnings about matters such as mercury, ciguatera and shellfish biotoxins are general information only and are not medical, health or food-safety advice. Risks vary by species, location and season. Never eat a fish you have not positively identified. Check local health warnings and closures, and seek medical advice if you feel unwell after eating seafood.
3.4 Weather, tides and conditions
Weather, swell, tide, solunar and conditions data comes from third-party and computed models and may be inaccurate. It is not suitable for navigation or for safety-critical decisions. Notifications suggesting good fishing conditions are a convenience feature based on your own past catches — they are not advice that it is safe to go out. Always check official marine warnings (the Bureau of Meteorology in Australia, MetService in New Zealand), and fish within your own and your vessel's limits. Fishing, boating and rock fishing carry an inherent risk of serious injury or death, which you assume.
4. Your responsibilities
- Fish legally, hold any required licence, and observe local rules.
- Positively identify anything you intend to keep or eat.
- Make your own safety assessment before going out.
- Only upload photographs you have the right to use, and don't upload unlawful, offensive or infringing content.
- Only enter another person's name in a shared session with their agreement.
- Don't misuse the App — no automated scraping, no attempts to circumvent usage limits or security, no interference with the service.
5. Your content
You keep ownership of the photographs and information you add. You grant us a limited licence to store, process and display that content solely to provide the App to you — including sending photographs to our AI providers for identification, and displaying a scorecard you choose to share. This licence ends when you delete the content or your account, except for copies we must retain by law or in routine backups.
If you create a share link, you are making that scorecard publicly accessible to anyone with the link. Please see the Privacy Policy for what a shared scorecard contains.
6. Subscriptions and payment
Freespool offers a free tier with limited AI identifications, and a paid subscription (“Freespool Pro”) unlocking additional features.
- Prices are shown in the App before purchase and may vary by region.
- Subscriptions are billed through the Apple App Store or Google Play, and those stores — not us — process your payment.
- Subscriptions renew automatically until cancelled. Cancel at least 24 hours before the period ends through your App Store or Google Play account settings.
- Where a free trial is offered, it converts to a paid subscription unless cancelled at least 24 hours before it ends.
- Refunds are handled by Apple or Google under their policies. Nothing here limits any non-excludable refund right you have under law.
- Pro includes a generous but finite fair-use limit on AI identifications to prevent abuse. We will tell you if you approach it.
- We may change prices or the features in each tier. We will give reasonable notice, and changes will not affect a period you have already paid for.
7. Availability and changes
We aim to keep the App available but do not guarantee uninterrupted service. Features depend on third-party providers and may change or become unavailable. We may modify, suspend or discontinue features; if we discontinue a paid feature materially, you may be entitled to a proportionate refund.
8. Intellectual property
The App, its design, its curated species and rules data, and the Freespool name and logo are owned by us or our licensors. Some content is provided under third-party licences and is attributed within the App.
9. Consumer guarantees and liability
Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded — including the New Zealand Consumer Guarantees Act 1993 where it applies. For major failures you are entitled to a replacement or refund, and to compensation for other reasonably foreseeable loss.
Subject to the paragraph above, and to the maximum extent permitted by law:
- The App and its information are provided “as is”. We do not warrant that species identifications, fishing rules, edibility information or conditions data are accurate, complete or current.
- We are not liable for indirect or consequential loss, loss of profit, or loss of data.
- We are not liable for fines, penalties or other consequences arising from your failure to comply with fishing laws.
- Where our liability can be limited but not excluded, it is limited (at our option) to resupplying the service or paying the cost of resupply.
You agree to indemnify us against claims arising from your breach of these terms or your unlawful use of the App.
10. Suspension and termination
You may stop using the App at any time and delete your account in the App. We may suspend or terminate access if you materially breach these terms, abuse the service, or where required by law. Sections 5, 8, 9 and 11 survive termination.
11. Governing law
These terms are governed by the laws of Western Australia, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. If you are a consumer in New Zealand, nothing here deprives you of the protection of New Zealand consumer law.
12. Changes to these terms
We may update these terms. Material changes will be notified in the App or by email before they take effect. Continuing to use the App after that means you accept the updated terms.
